1. About Aceloking

Aceloking ("we", "our", "us") is a managed cloud infrastructure service operated as a sole proprietorship under Indian law. We provide Dedicated Linux Servers (VPS), security hardening services, and related cloud infrastructure to developers, freelancers, and businesses.

2. Services Offered

Aceloking provides the following services:

• Dedicated Linux Servers (VPS) on European cloud infrastructure
• Automated security hardening of Linux servers (CIS benchmarks)
• Monthly GST-compliant invoicing in Indian Rupees (INR)
• UPI, debit card, credit card, and net banking payment processing via Razorpay
• Technical support via email in IST timezone
• Server monitoring and uptime reporting

Our servers are hosted on third-party European cloud infrastructure. Server data is physically located in Europe (Germany/France region). We do not operate Indian data centers. Customers requiring Indian data residency for legal compliance should not use our services.

3. Account Registration

To use Aceloking services, you must:

• Provide accurate, complete, and current registration information
• Verify your mobile number via OTP during registration
• Be at least 18 years of age
• Have the legal authority to enter into this agreement

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Acceptable Use Policy

You agree not to use Aceloking services for any of the following prohibited activities:

• Sending unsolicited bulk email (spam)
• Launching or participating in DDoS (Distributed Denial of Service) attacks
• Hosting, distributing, or transmitting illegal content of any kind
• Mining cryptocurrency of any kind (Bitcoin, Ethereum, Monero, or any other)
• Running port scanners or network vulnerability scanners targeting third-party systems
• Hosting phishing sites, malware, or any malicious software
• Violating any applicable Indian or international law
• Infringing any third-party intellectual property rights
• Running Tor exit nodes or similar anonymization services
• Any activity that violates the acceptable use policy of our infrastructure providers

We reserve the right to immediately suspend or terminate your service without notice or refund if we detect or receive reports of any prohibited activity originating from your server.

5. Payment Terms

All payments are processed in Indian Rupees (INR) via Razorpay. We accept UPI, debit cards, credit cards, and net banking.

• Services are billed monthly on a recurring subscription basis
• Billing begins on the date of server provisioning
• GST at 18% is applicable on all services (SAC Code: 998313)
• A GST-compliant invoice is generated and emailed automatically each billing cycle
• Failed payments will result in service suspension after a grace period of 7 days
• Services will be terminated after 14 days of failed payment

6. Service Availability

Aceloking targets 99% uptime but does not guarantee uninterrupted service. Downtime may occur due to:

• Scheduled maintenance (notified in advance via email)
• Infrastructure provider outages beyond our control
• Force majeure events

Service credits may be issued at our discretion for extended outages. We are not liable for losses arising from service interruptions.

7. Security and Data Responsibility

Aceloking applies OS-level security hardening to every server before delivery. This hardening follows CIS (Center for Internet Security) Level 1 benchmarks for Ubuntu 22.04.

However, this does not constitute a security guarantee. You are solely responsible for:

• The security of applications you install on your server
• Your data and database security
• Application-level vulnerabilities
• Access credentials and SSH key management
• Regular backups of your data

Aceloking is not liable for data loss, security breaches, or damages resulting from events beyond our OS-level hardening scope.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Aceloking's total liability to you for any claims arising from or related to these terms or our services shall not exceed the total fees paid by you in the 30 days immediately preceding the event giving rise to the claim.

Aceloking is not liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

9. Indemnification

You agree to indemnify, defend, and hold harmless Aceloking and its operators from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from your use of our services, your violation of these terms, or your violation of any third-party rights.

10. Cancellation and Termination

You may cancel your subscription at any time from your dashboard. Upon cancellation:

• Your server remains active until the end of your current billing period
• No further charges will be made after cancellation
• Your server and all data on it will be permanently deleted at period end
• We recommend taking a backup before cancellation

We reserve the right to terminate accounts that violate these terms, with or without notice.

11. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of India. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts in India.

12. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be communicated via email and posted on our website with an updated revision date. Continued use of our services after notification constitutes acceptance of the revised terms.
